Public Protector Busisiwe Mkhwebane has reacted very strongly against a court ruling over her Dairy Estina report appeal.

The North Gauteng High Court ruled against Mkhwebane’s appeal over the Estina report on Friday.

Mkhwebane wanted the court to overturn its decision to declare her Estina report unlawful, unconstitutional and also the personal cost directed to her.

However, judge Ronel Tolmay ruled against Mkhwebane’s bid to have her report’s findings stand.

Mkhwebane says she is not surprised that judge Tolmay has ruled against her on this matter.

Mkhwebane’s office has since stated that it will be taking this case to the Supreme Court of Appeal in Bloemfontein.

Mkhwebane’s Estina report was criticised across different sectors for its failure to hold the executive of the Free State accountable for the looting of funds in the Estina dairy project.

The Gupta family reported to have benefitted from the Estina Dairy Project.

Opposition parties such as the Democratic Alliance criticised Mkhwebane’s failure to find the then Premier of Free State Ace Magashule accountable in the project.

Despite Mkhwebane having exonerated Magashule and the then MEC of Agriculture Mosebenzi Zwane in her report, many farmers told the State Capture Commission about the role of the duo on the project.

The Estina Dairy project saw millions of taxpayers money which were meant to help emerging farmers in the Vrede community being reportedly channelled to the controversial Gupta family.
